GENERAL TERMS, USE & CONDITIONS: Floralia Living (the “Sponsor”) may post sweepstakes, giveaways, contests, and promotions (each a “Sweepstakes”) on social media or its websites, including www.floralialiving.com, and at POP-UP Events. By entering, you agree to these Official Rules and the Sponsor's final decisions. Our Sweepstakes are not sponsored or affiliated with Instagram, Facebook, Twitter, or any organization not named as a Sponsor. You are responsible for any wireless internet fees, and compatibility may vary by device and location.
SWEEPSTAKES/CONTEST DETAILS: To enter any Sweepstakes, follow the instructions on the Sponsor’s social media, website, or at events. The entry period and prize details will be on the Sweepstakes Description Page, which is part of these Rules. All dates are subject to change, and the Sponsor's clock is the official timekeeping device. To be eligible, entries must meet all requirements; incomplete entries may be disqualified. Only one entry is allowed; attempts to enter multiple times may result in disqualification. The prize’s value may change, and specifics are determined by the Sponsor. No cash substitutions or transfers are allowed, and all prize-related expenses, including taxes, are the winner's responsibility.
WHO IS ELIGIBLE: Sweepstakes are open only to residents of the 50 United States and the District of Columbia who are at least 18 years old. Employees of the Sponsor, prize providers, their immediate families, and anyone living with them, as well as the Sponsor’s agents and affiliates involved in the Sweepstakes, are not eligible to participate.
PUBLIC RELATIONS/MARKETING: If selected as a Sweepstakes winner, you consent to the Sponsor's use of your name and likeness for publicity, marketing, and advertising purposes without additional permission or compensation. By entering, you understand that the Sponsor and its affiliates can use your entry, name, image, and statements for promotional purposes globally, without further notice or compensation.
WINNER NOTIFICATION: Sweepstakes winners will be chosen by random with odds depending on the number of eligible entries. Potential winners may be announced on the Sponsor's social media page. Winners will be notified within five business days of the listed date, and must respond within 48 hours, providing their full name, address, phone number, and date of birth, and/or proof with a valid state issues ID. Failure to respond or provide accurate contact information will result in disqualification and forfeiture of the prize. Winners must also sign and return any required documents within 48 hours. Notifications returned as undeliverable may lead to disqualification, and invalid entries may result in alternate winners being chosen.
TAXES AND EXPENSES: Winners are responsible for all taxes and fees related to prize acceptance. Those receiving prizes valued at $600 or more will receive an IRS 1099 Tax Form and must complete an IRS W9 Tax Form to report the prize to the IRS as required by law.
RELEASE: By entering the Sweepstakes, each entrant agrees to indemnify and hold harmless the Sponsor and its affiliates from any claims or damages related to the Sweepstakes, including personal injury or property damage. This includes issues arising from entering the Sweepstakes, technological malfunctions, or acceptance/use of any prize. Participants agree that disputes will be resolved individually in a California court and waive the right to class action or claims for punitive, incidental, or consequential damages, except for actual out-of-pocket expenses related to entry.
MISCONDUCT: Sponsor reserves the right to disqualify or refuse entry to anyone who tampers with the Sweepstakes/Contest, acts unsportsmanlike or disruptively, violates these Official Rules. Automated entries will be void. The Sponsor may disqualify individuals believed to have intentionally violated these rules without notice. If the Sweepstakes is affected by human error, mechanical malfunctions, or other unforeseen events, the Sponsor may terminate it or make decisions as deemed appropriate, ensuring a fair distribution of prizes within stated limits. Waiving any rule does not constitute a permanent waiver. Any attempts to damage the Sweepstakes or its website may lead to legal action. Entries will be considered made by the authorized email account owner.
PRIVACY POLICY: By entering the Sweepstakes, you agree to receive occasional email newsletters from the Sponsor, which you can unsubscribe from anytime. The Sponsor will handle your personal information as outlined in their Privacy Policy.
